Section 01Terms of Use

Welcome to Smart Money Move Academy (SMMA). These terms govern your purchase and use of any product we offer, including the Smart Prompt Builder, China Import Navigator AI, and the SMMA Premium Community. By purchasing or using our products, you agree to these terms in full.

Our products and prices

• Smart Prompt Builder — £127 one-time payment, lifetime access.
• China Import Navigator AI — £100 one-time payment, lifetime access.
• Smart Money Move Academy Premium Community — £250 one-time payment, lifetime access.

Eligibility

You must be aged 18 or over to purchase any product. By purchasing, you confirm you meet this requirement.

Access codes

Each product is unlocked using a unique access code delivered after purchase. Your access code is personal, non-transferable, and locked to a maximum of two of your devices. Sharing your code with anyone else is a breach of these terms and will result in your code being revoked without refund.

Results disclaimer

Our products are educational tools designed to help you make informed decisions. We do not guarantee any specific financial, business, or personal results. Your outcomes depend on your own effort, choices, and market conditions. Any figures or case studies shared are illustrative only.

Changes to these terms

We may update these terms from time to time. The current version will always be available on our website. Continued use of the product after an update means you accept the new terms.

Governing law

These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.

Section 02Licence Agreement

When you purchase a product from Smart Money Move Academy, you are buying a single-user, non-transferable licence to use that product. You are not buying the product itself or any rights to its underlying code, design, or content.

What you can do

• Use the product for your own personal or business purposes.
• Use any prompts, outputs, or materials generated by the product for your own client work or business activities.
• Access the product on up to two of your own devices.

What you cannot do

• Share, sell, rent, or redistribute the product, your access code, or any part of it with any other person or business.
• Copy, reverse-engineer, decompile, or attempt to extract the source code.
• Remove, modify, or obscure any watermarks, branding, or ownership notices.
• Pass off the product or its content as your own creation.
• Use the product for any illegal, harmful, or fraudulent purpose.

Consequences of breach

If we believe you have breached this licence, we reserve the right to immediately revoke your access without refund and, where appropriate, take legal action to recover any losses caused by your breach.

Section 03Intellectual Property

All products, tools, designs, code, prompt templates, written content, and methodologies developed by Smart Money Move Academy are the intellectual property of Jorrellys Francis. This includes but is not limited to the Smart Prompt Builder interface, the China Import Navigator AI, all course material inside Smart Money Move Academy Premium Community, and all supporting documents, PDFs, and graphics.

Your generated outputs

Outputs you personally generate using our tools (for example, a specific prompt you build in the Smart Prompt Builder, or a supplier report you generate in China Import Navigator AI) are yours to use commercially. However, the underlying tool, templates, and engine that produced those outputs remain our property.

Trademarks

Smart Money Move, Smart Money Move Academy, SMMA, Smart Prompt Builder, China Import Navigator AI, and related logos are trademarks of Jorrellys Francis. You may not use our trademarks without our written permission.

Reporting infringement

If you believe someone is distributing our product without authorisation, please email hello@smartmoneymove.co.uk with details.

Section 04Privacy Policy

This privacy policy explains what personal data we collect, why we collect it, how we use it, and your rights under UK GDPR and the Data Protection Act 2018.

Who is responsible for your data

Jorrellys Francis, trading as Smart Money Move Academy, is the data controller for any personal data you share with us. You can contact us at hello@smartmoneymove.co.uk.

What we collect

• Your name and email address when you purchase a product or join our mailing list.
• Your access code and the device identifier associated with it, for licence verification purposes.
• Basic usage data such as which features you interact with, for product improvement.

Our lawful basis

We process your personal data on the following lawful bases under UK GDPR:

• Contract — to deliver the product you purchased and provide customer support.
• Legitimate interest — to improve our products, prevent fraud, and communicate with you about your purchase.
• Consent — for marketing emails, which you opt into separately and can unsubscribe from at any time.

How we store and protect your data

Your access code and device identifier are stored locally on your device and securely in our Cloudflare Worker infrastructure. Your email and purchase details are held by the payment platform you bought through (Payhip, Beacons, or Etsy), by our email platform (MailerLite), and in our secure Google Drive records. We do not sell your data to anyone, ever.

Third parties who process your data

• Beacons — product delivery and storefront.
• Payhip — payment processing and digital file delivery.
• Etsy — payment processing (where applicable).
• MailerLite — email delivery.
• Cloudflare — infrastructure and access code verification.
• Google — document and record storage.

Your rights

Under UK GDPR you have the right to:

• Request a copy of the personal data we hold about you.
• Correct inaccurate data.
• Request deletion of your data.
• Object to processing or withdraw consent for marketing.
• Request transfer of your data to another provider.
• Complain to the Information Commissioner's Office at ico.org.uk.

How long we keep your data

Purchase records are kept for six years to meet HMRC requirements. Email subscriptions are kept until you unsubscribe. Access codes remain active for the lifetime of the product.

Cookies

Our tools use local browser storage to remember your access code on your device so you do not have to re-enter it every time. This is essential to the function of the product. We do not use tracking cookies for advertising.

Section 05Refund Policy

Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, buyers have a statutory 14 day right to cancel purchases made online. Smart Money Move Academy respects and complies with this right.

In practice this means

• If your access code has not yet been claimed, you may request a full refund within 14 days of purchase by emailing hello@smartmoneymove.co.uk.
• Once your access code has been claimed and the tool has been accessed, no refunds will be issued, as the digital content has been delivered and consumed.
• Access codes are unique, single-purchase, and device-locked. Sharing your code with others is a breach of the single-user licence and will result in your code being revoked without refund.
• We reserve the right to refuse refund requests where we reasonably believe the digital content exception applies, or where we suspect fraudulent activity, chargeback abuse, or attempts to copy and redistribute our content.

Faulty products

If a product is genuinely not working as described and we cannot resolve the issue within a reasonable time, you are entitled to a refund regardless of the digital content exception. Please email hello@smartmoneymove.co.uk with a description of the issue and we will investigate.

How to request a refund

Email hello@smartmoneymove.co.uk with your purchase email address, order number, and a brief explanation. We aim to respond within two working days. Approved refunds are processed within seven working days through your original payment method.

Section 06Acceptable Use

When using any Smart Money Move Academy product or community, you agree not to:

• Use the product for any illegal, harmful, or fraudulent activity.
• Attempt to bypass the access code system or any other security measure.
• Share your access code publicly, on social media, in forums, or privately with non-buyers.
• Copy, screenshot, or record the tool interface for the purpose of redistributing it.
• Use the SMMA Premium Community to spam, recruit, or promote unrelated products.
• Harass, abuse, or discriminate against other community members.
• Misrepresent yourself, your business, or your qualifications inside the community.

Community guidelines

Members of SMMA Premium Community are expected to treat each other with respect. Breaches of community guidelines may result in removal from the community without refund.

Section 07Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any loss or damage arising out of or in connection with your use of any Smart Money Move Academy product is limited to the price you paid for that product.

We are not liable for

• The quality, accuracy, or suitability of any output generated by AI tools within our products. AI outputs should always be reviewed by you before use.
• Changes, restrictions, or outages of third-party platforms referenced in our products (for example Alibaba, Amazon, TikTok Shop, eBay, HMRC tools, or any AI provider).
• Indirect, consequential, or special losses, including loss of profit, loss of business, or loss of data.
• Any financial decisions you make based on information from our products. Our products are educational and do not constitute regulated financial, legal, or tax advice.

Your statutory rights

Nothing in these terms limits or excludes your statutory rights as a consumer under UK law.
